The case revolves around the appeal (Criminal Appeal No. 1167 of 2018) brought by Ballu Chaurasiya and another appellant against the State of Madhya Pradesh. They challenged the judgment of the High Court of Madhya Pradesh, which overturned the acquittal by the trial court and convicted them under Sections 302 and 201/34 of the Indian Penal Code (IPC), sentencing them to rigorous imprisonment for life and other terms.
The prosecution’s case involved the death of Mahesh Sahu, allegedly caused by the appellants due to his relationship with Anita, sister of one of the appellants. The incident occurred on 7th June 1992, and the prosecution relied on circumstantial evidence, including eyewitness testimonies and the discovery of bloodstains.
During the trial, testimonies of witnesses, including the father and mother of the deceased, were heavily scrutinized. The trial court found discrepancies and inconsistencies in their statements, casting doubt on their credibility. Additionally, crucial witnesses turned hostile, weakening the prosecution’s case.
The trial court meticulously analyzed the evidence, highlighting various inconsistencies and improbabilities in the prosecution’s narrative. It concluded that the prosecution failed to establish guilt beyond reasonable doubt, leading to the acquittal of the appellants.
However, the High Court, in a brief manner, reversed the trial court’s decision, relying on interpretations of witness testimonies and forensic evidence. It found the appellants guilty based on conjectures and surmises, ignoring the principles governing appeals against acquittals.
The appellants’ counsel argued that the High Court erred in disregarding the trial court’s reasoned judgment and that the prosecution’s case lacked sufficient evidence to establish guilt beyond a reasonable doubt.
Ultimately, the Supreme Court, upon careful consideration, found the High Court’s judgment unsustainable. It emphasized the importance of adherence to legal principles and overturned the conviction, acquitting the appellants of all charges.
